Resolution
Supporting the protection of
the voting rights of all citizens
WHEREAS, for 75 years, the
League of United Latin American Citizens (LULAC)
has been the champion in the battle for Hispanic
Civil Rights; and
WHEREAS, one of
the foundations of democracy in the United
States of America is the right to vote and to
have that vote accurately counted; and
WHEREAS, Direct
Recording Electronic (DRE’s) voting machines and
software are a new and unproven technology; and
WHEREAS,
election officials have not been adequately
trained in the use of Diebold DRES’s in the
counties of San Diego, Solano, San Joaquin and
Kern and set conditions for the use of DRE’a in
all other California counties on April 30, 2004;
and
WHEREAS, Senator
Don Perata (D-Alameda) and Ross Johnson
(R-Irvine) have taken the bipartisan initiative
with SB 1723 to ban the use of all DRE’s until
January 1, 2005; and
WHEREAS, LULAC
District XIII requested the California Secretary
of State in an April 24, 2004 letter to ban the
use of all DRE’s. On April 28, LULAC Lorenzo
Patino council members, Dr. Armando Ayala and
Dr. David Bayer, representing District XIII,
testified before the California state Voting
Systems Panel, and read the April 24 letter into
the official record.
NOW THERFORE BE IT
RESOLVED, by the 2004 California State
Convention of LULAC, held May 21-23 in Concord,
CA that California LULAC supports SB 1723 and
directs the California Secretary of State to
immediately ban any and all machines which do
not provide a paper verification process.
