League of United American Citizens Workers Bill of Rights
 

WHEREAS, our country and its labor movement were built in large part by immigrants. 

WHEREAS, The ability of workers to organize has been increasingly threatened by current immigration law and its enforcement, which has been used to retaliate against workers who organize and protest against sweat-shop conditions. 

WHEREAS, LULAC stands for the equality of all workers.  Immigration Legislation and its enforcement which divides workers undermine that strength.  All workers, regardless of immigration status, have the right to form unions; file complaints against illegal and unfair treatment, without fear of reprisal. 

WHEREAS, First Amendment, The Right to Free Speech in the Workplace, every year one out of ten workers speak out in favor of improving their working conditions and organizing a union under Sec. 7 of the NLRB Act (Federal Law) are fired from his or her job.  Thousands more are silenced by threats of retaliation by employers who do not respect the law and rights of workers to organize. 

WHEREAS, Second Amendment, The Right to Free Association without employer interference or intimidation.  Today only 13% of American workers are in unions.  In Canada, Germany and most developed countries twice as many workers join unions.  Over 25,000 federal NLRB changes are filed every year accusing employers with violating worker’s rights to organize. 

WHEREAS, Third Amendment, The Right To The Presumption of Innocence and Swift Justice most employees who have been illegally fired are found innocent during the first month of the National Labor Relations Board investigation into their cases.  Despite this it takes an average of 750 days before NLRB process is completed and reinstatement is ordered. 

WHEREAS, Employers regularly break the law because they know that the National Labor Relations Board process is very slow.

NOW THEREFORE, BE IT RESOLVED, That LULAC urges our Congressional Representatives to support and amend labor law reforms in this country and to treat all workers equally irrespective of their immigration status.
