RESOLUTION

Equal Administration of Justice Denied

WHEREAS, the League of United Latin American Citizens, advances the economic condition, educational attainment, political influence, health and civil rights of Hispanic Americans in the United States; and,

WHEREAS, the LULAC Constitution states the organization aims to "combat all un-American tendencies and actions that deprive American citizens of their rights in educational institutions, in economic pursuit and in social, civic and political activities"; and,

WHEREAS, a 13-year-old Hispanic female was killed by a 53-year-old Anglo drunk driver as she attempted to cross a street; and,

WHEREAS, the driver faced multiple charges, including injury to a child, intoxicated manslaughter and leaving the scene of an accident, and yet the judge - no jury - decreed him guilty only of driving while intoxicated; and,

WHEREAS, LULAC Council 4692 vehemently deplored the court's finding and staged a protest outside the courthouse. Additionally, information relevant to said case was gathered and submitted through proper channels to LULAC state representatives for further assessment;

NOW THERFORE, BE IT RESOLVED, that LULAC Council 4692 in Victoria, Texas, together with the officers of LULAC District 10; on June 1, 2001 respectfully request the following:

1) A report regarding LULAC state representative's assessment of this incident and/or;
2) Information regarding the resolve or closure of the incident and/or;
3) Legal advice to determine a pathforward applicable to this and future incidents.
